Reference is made to PESTECH’s announcements made on 27 June 2023, 3 July 2023, 7 July 2023, 20 July 2023, 3 August 2023, 7 September 2023, 5 December 2023 and 8 January 2024 in relation to the suit proper before the High Court between PESTECH Sdn. Bhd. (“PSB”) against Syarikat Pembenaan Yeoh Tiong Lay Sdn. Bhd. (“SPYTL”) to restrain SPYTL from trespassing, utilising and/or otherwise tampering with machineries belonging to PSB.
During the case management held today, SPYTL has filed the application for stay of trial proceedings (“Stay Application”). The Court has directed that all the other pre-trial case management directions be suspended pending disposal of this Stay Application.
The Court has given the following directions in regard to the Stay Application:-
- SPYTL to file and serve the Affidavit in Support by 23 January 2024;
- PSB to file and serve the Affidavit in Reply by 9 February 2024;
- SPYTL to file and serve the Affidavit in Reply (if any) by 16 February 2024; and
- Written Submissions to be filed and served by 28 February 2024.
The Stay Application has been fixed for hearing on 1 March 2024.
