UPDATES ON MATERIAL LITIGATION - KUALA LUMPUR HIGH COURT SUIT WA-22C-44-06/2023

Reference is made to PESTECH’s announcements made on 27 June 2023, 3 July 2023, 7 July 2023, 20 July 2023, 3 August 2023, 7 September 2023, 5 December 2023, 8 January 2024 and 10 January 2024 in relation to the filing of application for stay of trial proceedings (“Stay Application”) by Syarikat Pembenaan Yeoh Tiong Lay Sdn. Bhd. (“SPYTL”) on the suit proper before the High Court between PESTECH Sdn. Bhd. (“PSB”) and SPYTL to restrain SPYTL from trespassing, utilising and/or otherwise tampering with machineries belonging to PSB.
SPYTL had requested for leave to address the Court on the following matters that occurred after the hearing of the Stay Application, namely:-
a) The arbitration proceedings between SPYTL, PESTECH Technology Sdn. Bhd. and PESTECH; and
b) The Court of Appeal’s hearing on 2 May 2024 in relation to the machineries injunction.
During the case management held yesterday, the Court has given the following directions in regard to the Stay Application:-
a) SPYTL is to file and serve their Further Affidavit by 29 May 2024;
b) PSB is to file and serve their reply to SPYTL’s Further Affidavit by 18 June 2024; and
c) Parties are to file and serve further Written Submissions on 5 July 2024.
The decision for SPYTL’s Stay Application and case management for the suit have been fixed on 11 July 2024.
